Cryptocurrency is fully legal in Belarus under Presidential Decree No. 8 "On Development of Digital Economy" signed on December 21, 2017, which came into force on March 28, 2018. The decree legalized a broad spectrum of activities including mining, trading, exchanging cryptocurrencies, and treating them as legitimate digital assets akin to property rights (1). Natural persons are entitled to perform mining, store tokens in virtual wallets, exchange tokens for other tokens, acquire and alienate them for Belarusian rubles or foreign currency, and donate or bequeath tokens without such activity constituting entrepreneurial activity or requiring declaration.
The regulatory framework established by Decree No. 8 extended the special legal regime of the High-Tech Park until January 1, 2049, granting residents significant benefits and regulatory clarity for blockchain and cryptocurrency operations. The decree provided comprehensive tax exemptions initially until January 1, 2023, exempting mining, token issuance, and trading activities from value-added tax, profit tax, and personal income tax (1). Legal persons can create and place tokens through High-Tech Park residents, while cryptographic platform operators and cryptocurrency exchange operators must maintain minimum reserves in Belarusian banks and are authorized to perform various token-related operations including placement, acquisition, and exchange services.
"The sphere of digital tokens, which include cryptocurrencies, is indeed complicated. It is new and most importantly it is risky. Today every person, every citizen of the Republic of Belarus needs to understand that the sphere of cryptocurrencies is for those, who knows these things."
Regulations in the cryptocurrency sphere continue to develop based on law enforcement practices, with the Hi-Tech Park supervisory board regularly releasing enactments to regulate various aspects. Communications and Informatization Minister Kirill Zalessky confirmed that regulation involves constant collaboration with government agencies including the National Bank, State Control Committee, and Operations and Analysis Center (2). The government maintains efforts to minimize losses for law-abiding citizens while erecting barriers against abuses, having blocked numerous scams since 2018 and implementing decisions on natural person operations to maintain order in the cryptocurrency market.
