Cryptocurrency is legal in the Czech Republic and subject to comprehensive regulation following the implementation of Act No. 31/2025 on Digitalisation of the Financial Market, which took effect on February 15, 2025. The legislation established the Czech National Bank as the competent regulatory authority for crypto-assets under the EU's Markets in Crypto-Assets Regulation (1). Virtual asset service providers are classified as financial institutions under the Anti-Money Laundering Act, requiring registration and compliance with AML/CFT obligations from December 30, 2024 (2).
The Czech National Bank accepts applications for crypto-asset service provider authorization under Article 63 of MiCA Regulation, as well as notifications for white papers, asset-referenced tokens, and electronic money tokens. Entities that provided crypto-asset services under trade licenses prior to December 30, 2024, must submit CASP authorization applications by July 31, 2025, and may continue operations until their applications are decided or until July 1, 2026, whichever comes first (1). The Financial Analytical Unit issues permits for services involving unique and non-fungible crypto-assets not covered by MiCA regulation (2).

Czech legislation introduced banking access rights for licensed cryptocurrency companies, established clear tax rules for crypto transactions, and ensured long-term regulatory stability. Cryptocurrency income below 100,000 CZK annually is exempt from tax reporting, while higher earnings face standard income taxation (1). The Czech National Bank Governor proposed in January 2025 to analyze creating a Bitcoin test portfolio in the country's foreign exchange reserves, reflecting growing institutional interest in digital assets (1). MiCA implementation positioned the Czech Republic as a gateway to the European market for cryptocurrency businesses worldwide (1).
