Cryptocurrency is legal in Denmark, where it is treated as a personal asset rather than legal tender by the Danish Financial Supervisory Authority and Danmarks Nationalbank. The country implemented the EU's Markets in Crypto-Assets Regulation on December 30, 2024, establishing comprehensive licensing requirements for crypto-asset service providers operating in Denmark (1). A household survey conducted by Danmarks Nationalbank in 2023 revealed that only 4 percent of Danish citizens own crypto-assets, with 86 percent regarding them as investment objects rather than payment instruments (2).
The Danish Financial Supervisory Authority oversees registration and supervision of crypto-asset service providers, requiring them to comply with anti-money laundering obligations and MiCA framework standards. Finanstilsynet published guidance on assessing decentralization in June 2024, clarifying that offerings conducted in fully decentralized manner without identifiable counterparties fall outside MiCA's regulatory scope (1). The transitional period for existing crypto service providers ends on December 30, 2025, after which only authorized CASPs may legally provide services in Denmark (1).

Danmarks Nationalbank concluded that crypto-assets do not currently pose significant threats to financial stability, as holdings among Danish households and businesses remain limited while the traditional financial sector maintains cautious approach with minimal interlinkages to crypto markets. The Danish Tax Agency treats gains from speculative trading as taxable personal income, with tax rates reaching up to 52.07 percent, while crypto-to-crypto trades are not taxed until converted to fiat currency (2). Executive Order No. 1155/2025 introduced reporting obligations for crypto-asset service providers under DAC8, requiring annual submission of user and transaction data by January 31 starting in 2027 (2).
