Is Crypto Legal in Guadeloupe?

Cryptocurrency is legal in Guadeloupe, as the territory follows French cryptocurrency regulations under the PACTE Act established in May 2019. As an overseas department of France, Guadeloupe operates under French law, which created a comprehensive regulatory framework for digital asset service providers and initial coin offerings. Digital Asset Service Providers offering custody of crypto-assets or buying and selling crypto-assets in legal currency must register with the Autorité des Marchés Financiers before providing services (1).

The French framework provides both mandatory registration for certain services and an optional licensing system for crypto businesses seeking enhanced credibility. Under PACTE regulations, digital asset service providers must comply with strict anti-money laundering standards, honourability and competence requirements for managers, and know-your-customer obligations. Registered providers gain unrestricted access to banking services, as credit institutions cannot refuse deposit and payment account services to AMF-registered entities (1).

"When registered, crypto-custodians and crypto-fiat service providers are added to the DASP white list held by the AMF. For crypto-crypto service providers and digital assets trading facilities, there's no pre-approval process by the AMF."

From December 30, 2024, the European Union's Markets in Crypto-Assets Regulation became the primary regulatory framework replacing national laws including PACTE. The MiCA Regulation establishes harmonized rules across all EU member states and territories, requiring crypto-asset service providers to obtain authorization before operating. Existing French Digital Asset Service Providers can continue operations until July 2026 while transitioning to MiCA compliance, after which all providers must meet the European standard for authorization as crypto-asset service providers (2).
