Cryptocurrency businesses operating in Guam must comply with federal Bank Secrecy Act requirements, which authorize the Department of the Treasury to impose reporting and other requirements on financial institutions to help detect and prevent money laundering (1).
Under federal law, digital asset service providers including cryptocurrency exchanges, wallet providers, and money transmitters must register with the Financial Crimes Enforcement Network as money services businesses. The BSA requires financial institutions to keep records of cash purchases of negotiable instruments, file reports of cash transactions exceeding ten thousand dollars, and report suspicious activity that might signify money laundering, tax evasion, or other criminal activities. These requirements apply to cryptocurrency businesses throughout all U.S. territories including Guam (1).

For tax purposes, digital assets are considered property rather than currency in Guam as throughout the United States. Taxpayers receiving digital assets as payment for services, mining rewards, or through sales and exchanges must answer the digital assets question on Form 1040 and report transactions using Form 8949 for capital assets or Schedule C for business income (2).
