Following a public consultation in 2024, the IOMFSA decided to maintain the current approach rather than expand the regulatory perimeter under the Financial Services Act 2008. Virtual currency businesses must comply with Anti-Money Laundering and Countering the Financing of Terrorism regulations as convertible virtual currency activities (1).
The Isle of Man Financial Services Authority's approach to regulation is technology-neutral, meaning it does not regulate Distributed Ledger Technology itself but will regulate applications or uses of DLT that come within the regulatory framework. The IOMFSA published guidance on cryptoasset and token activity illustrating which token-related activities may have regulatory implications. Security tokens and electronic money tokens are examples of uses that require specific regulatory oversight beyond basic registration requirements (2).

Virtual currency businesses must meet fit and proper requirements and demonstrate adequate governance and risk management structures. The registration covers activities including issuing, transmitting, transferring, providing safe custody or storage of, administering, managing, lending, buying, selling, exchanging or otherwise trading convertible virtual currencies and cryptocurrencies. The IOMFSA continues monitoring developments in international standards and regulatory frameworks in other jurisdictions, with any future proposals to change the regulatory perimeter subject to further consultation (1).
