Cryptocurrency is legal in Luxembourg under the European Union's Markets in Crypto-Assets Regulation (MiCAR), which became fully applicable on December 30, 2024 (1). The Commission de Surveillance du Secteur Financier (CSSF) has been designated as the competent authority responsible for ensuring the application of MiCAR in Luxembourg (2). The law of February 6, 2025 established national rules for implementing MiCAR, positioning Luxembourg as a strategic hub for digital assets (2).
MiCAR creates a harmonized regulatory framework governing the issuance, public offering, and admission to trading of crypto-assets, as well as the provision of crypto-asset services (1). Crypto-asset service providers are subject to an authorization regime involving prudential and organizational requirements and will be supervised by the CSSF (1). Some categories of financial entities that already have regulated status—including credit institutions, investment firms, and electronic money institutions—can provide certain crypto-asset services upon simple notification (1).

Virtual asset service providers registered before December 30, 2024 benefit from a transitional period allowing them to continue operations until July 1, 2026 or until they receive authorization or refusal under MiCAR, whichever occurs sooner (1). The CSSF has been granted supervisory and investigative powers, including on-site inspections, and may impose administrative sanctions for noncompliance (2). MiCAR entered into force on June 29, 2023 and became applicable for asset-referenced tokens and e-money tokens on June 30, 2024 (1).
