Is Crypto Legal in Peru?

Cryptocurrencies are not recognized as legal tender in Peru; the Central Reserve Bank of Peru (BCRP) has stated that digital assets do not have the status of “moneda de curso legal” and are not backed by any central bank (1).

Although the Peruvian government has not criminalized the use or possession of cryptocurrencies, regulatory oversight is focused on anti-money laundering measures. The Superintendencia de Banca, Seguros y AFP (SBS) requires virtual asset service providers to register and comply with financial intelligence supervision (2).

"La SBS, mediante Decreto Supremo N.°006-2023-JUS del 27 de julio de 2023, incorporó a los proveedores de servicios de activos virtuales como sujetos obligados en materia de prevención del lavado de activos y financiamiento del terrorismo, y con la Resolución N.°02648-2024 aprobó la norma aplicable."

Private individuals and companies may buy, sell, and hold cryptocurrencies through unregulated exchanges and peer-to-peer platforms, but these activities lack specific licensing and consumer protections. The BCRP continues to study digital currency frameworks, including potential central bank digital currencies, for future regulation (1).
