Is Crypto Legal in Poland?

Cryptocurrency activities in Poland are neither explicitly prohibited nor formally regulated by domestic law. The National Bank of Poland (NBP) and the Polish Financial Supervision Authority (KNF) have clarified that while buying, holding, and selling virtual currencies is not illegal, these assets are not recognized as legal tender or financial instruments under Polish legislation (1).

Under current Polish law, trading crypto-assets through entities based outside the EU is not subject to supervision or oversight. Such entities are not classified as obligated institutions under the Anti-Money Laundering and Counter-Terrorism Financing Act of 2018, exposing users to higher risks of fraud and market volatility (1).

"The trading of virtual currencies (including crypto-currencies) through entities headquartered outside the territory of Poland and other Member States of the European Union is not regulated or supervised in Poland, which increases the risk of their abuse for money laundering and financing of terrorism purposes."

Looking ahead, the EU’s Markets in Crypto-assets Regulation (MiCA) will enter into force on 30 December 2024, setting uniform rules for crypto service providers and issuers across member states. Poland will need to adopt national legislation to vest supervisory authority over crypto-asset services in the KNF (2).
