Cryptocurrency is legal in Slovakia, where crypto-assets are recognized as digital assets based on cryptography and distributed ledger technology (1). However, crypto-assets are not considered financial instruments under Slovak law, nor do they qualify as legal tender or securities (1). According to Slovak legislation, virtual currency is defined as a digital value carrier not issued or guaranteed by a central bank or public authority, not tied to legal tender, and accepted by certain parties as an instrument of exchange (1).
Since December 30, 2024, the Markets in Crypto-Assets (MiCA) regulation applies in Slovakia, requiring crypto-asset service providers to obtain authorization from the National Bank of Slovakia to offer services such as custody, trading platforms, and exchange operations (2). Virtual asset service providers must register with the Trade Licensing Office to operate exchange services between virtual currencies and fiat currencies or provide custodian wallet services (2). Entities authorized before December 30, 2024 may continue operations until December 30, 2025, after which only licensed providers can operate (2).
"Slovakia is part of the European Union, which provides a stable regulatory environment and access to the EU market. Fintech companies can benefit from harmonized regulations and funding opportunities through EU programs."
Under Slovak accounting legislation, cryptocurrencies are recognized as short-term financial assets when purchased, acquired through mining and exchanged, or exchanged for another cryptocurrency (1). The Slovak Republic introduced legislation regulating taxation and accounting for cryptocurrencies in 2018 as one of the first countries (1). Authorization from the National Bank of Slovakia enables EU-wide passporting, allowing Slovak-licensed providers to operate across all EU member states (2).
