Cryptocurrency is not illegal in Sudan, but it operates in an unregulated legal gray area without specific legislation governing its use (2). The Central Bank of Sudan has issued warnings stating that digital currencies are not classified as money or private property under current legislation and regulations (1). The bank has cautioned citizens that cryptocurrencies carry high risks including financial crimes, electronic piracy, and significant loss of value (1). Despite these warnings, no formal ban exists, and peer-to-peer holding and trading of crypto remain permissible (2).
The only existing legal framework that touches on digital transactions is the Electronic Transactions Act of 2007, which was enacted before Bitcoin's rise and therefore does not cover cryptocurrencies (2). This Act addresses electronic payments generally and includes provisions for protecting information secrecy and detailing electronic contracting processes, but leaves virtual currencies outside its scope (2). In June 2020, Sudan joined the Better Than Cash Alliance as part of its Digital Transformation Agency initiative to modernize government services and payment systems (2).

The Central Bank of Sudan exercises its regulatory authority through circulars and has the power to freeze bank accounts related to suspicious activities (1). Cryptocurrency users in Sudan face legal uncertainty as digital assets are not permitted for paying invoices, which must be settled in Sudanese pounds or approved foreign currencies (2). Given that only about 31 percent of Sudan's population has internet access, cryptocurrency adoption remains limited primarily to urban areas like Khartoum and among tech companies and investors (2).
